These Terms of Use (“Terms”) govern your use of the public marketing website at millenniumomaha.com(the “Site”), operated by Millennium Commercial Group, owner and manager of Millennium Plaza at 15858 W. Dodge Road, Omaha, Nebraska 68118 (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you use the tenant portal, the additional terms in the “Tenant Portal Terms” section below also apply.

Using the Site

You may browse the Site, read our journal, view leasing information, and submit our forms for lawful, personal, or business purposes. You agree not to:

• use the Site in a way that violates any law or these Terms;
• interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems;
• scrape, harvest, or use automated means to collect data from the Site except as permitted by our robots file; or
• misrepresent your identity or submit false information.

Listings and pricing are informational

Space availability, square footage, rental rates, NNN estimates, and other leasing details on the Site are provided for general information and marketing purposes. They are estimates, may change, and are not an offer or a binding commitment. Actual terms are set only in a signed lease.

Form submissions are requests, not agreements

Submitting a tour request, contact message, spec-sheet request, or other form is a request for information or follow-up. It does not create a lease, reservation, or any binding agreement. By submitting a form, you confirm that the information you provide is accurate and that you consent to be contacted by us about your inquiry. If your submission includes another person’s contact information, you confirm you have their permission to share it.

Intellectual property

The Site and its content — including text, photographs, renderings, logos, branding, and design — are owned by Millennium Commercial Group or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission, except for ordinary personal or internal business reference.

Third-party links

The Site may link to third-party websites and services. We are not responsible for their content, products, or practices, and linking does not imply endorsement.

Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current.

Limitation of liability

To the fullest extent permitted by law, Millennium Commercial Group and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Site — even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Millennium Commercial Group and its affiliates from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms.

Changes

We may update these Terms from time to time. Continued use of the Site after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Douglas County, Nebraska.

Tenant Portal Terms

This section applies in addition tothe Terms above and governs your use of the authenticated tenant portal (the “Portal”). By signing in to or using the Portal, you agree to these Portal Terms. If you do not agree, do not use the Portal.

Eligibility and accounts

The Portal is available only to current tenants of Millennium Plaza and their authorized team members. Accounts are created by invitation only; there is no open sign-up. Your company’s designated administrator may invite and manage the access of additional team members. You are responsible for keeping your list of authorized users accurate and for removing people who should no longer have access.

Account security

• Keep your login credentials confidential and do not share them. Each account is for one person.
• You are responsible for activity that occurs under your account.
• Notify us promptly at info@millenniumomaha.com if you believe your account has been compromised or accessed without authorization.

Acceptable use

You agree to use the Portal only for legitimate purposes related to your tenancy, and not to:

• access or attempt to access data belonging to another tenant or account;
• interfere with, disrupt, probe, or reverse-engineer the Portal or its security;
• use automated means to access the Portal except as we expressly permit; or
• submit false, misleading, or unlawful information.

When you submit a referral or otherwise provide another person’s contact information through the Portal, you confirm that you have the right to share it.

Portal requests are requests, subject to approval

Maintenance requests, board-room bookings, access and key-card requests, and similar submissions are requests that are reviewed and handled at the discretion of building management and subject to availability and approval. Submitting a request does not guarantee it will be fulfilled, scheduled, or granted, and does not by itself create any obligation on our part. For emergencies, follow the emergency procedures communicated by building management rather than relying on a Portal submission alone.

The Portal does not change your lease

The Portal is a convenience for managing aspects of your tenancy. It does not amend, replace, or waive any part of your signed lease. Nothing you do in the Portal, and nothing shown in it, modifies your lease obligations or ours. If anything in the Portal conflicts with your lease, the lease controls. Your tenancy is governed by your lease.

Availability, suspension, and termination

We aim to keep the Portal available but do not guarantee uninterrupted or error-free access; the disclaimer of warranties and limitation of liability above apply to the Portal as well. We may suspend or terminate Portal access at any time — for example, if the tenancy ends, if an account is misused, or for security or maintenance reasons. Portal access is tied to your tenancy and ends when your tenancy ends. Termination of Portal access does not affect your lease rights or obligations. Information submitted through the Portal is handled as described in our Privacy Policy.
